any idea why this is happening?

its only on a fresh boot.

does this happen to anyone else?

Remote Buddy, like any application, needs time to start - which will 
take longer if its started upon login/boot time, because OS X itself 
will still do a lot of disk I/O after logging in, slowing down any 
other application that's starting at the same time.

Thank you for the reply. I understand that it takes a while to load.

What I'm experiencing is the computer will boot, load remote buddy and everything else.

If I walk away for like 5-10mins and come back it STILL requires me to press the menu button a few times before it responds.

In that case, it's well possible that the battery of your remote is 
low and it sends a "low battery" signal for the first couple of 
presses instead of the actual button press info.

What's your hardware config (Which Mac? Internal or external receiver?)?

Hmmm I wonder if that could be it. Althou that would be kinda weird, as it only does it on reboot.

I have a intel Mac Mini 1.8 its about 3 months old now, using the oem apple remote for now.

You wouldn't be the first one to get an Apple Remote with factory- 
preinstalled, empty batteries or batteries with a very low energy 
level. I've received several reports of either case in the past already.
