Is there a way to get the menu icon to stay up in the top menu whether the app. running or not? I prefer just having a using the menu icon but find that i need the dock button just to open the app.

Thanks for asking.

In order for an OS X app to provide an icon in the menu bar in a 
system-conform way, that app needs to run.

You can, however, configure Remote Buddy to only show its icon in the 
dock, only in the menu or in both (which is the default). You can also 
configure Remote Buddy to automatically start at login time. (find 
both options at Remote Buddy > Prefs > General).
