This posting is older than 6 months and can contain outdated information.
I am having the exact same problem this poster described. Just upgraded to Lion (Final Release Version) and the menu button does nothing unless I enter preferences first. Simply entering preferences and quitting without changing anything causes the remote to work correctly..
